Here we describe how we collect, use and handle your information when you use our websites, software and services ("Services").:

The knowledge and consent of the individual are required for the collection, use or disclosure of personal information, except where consent is not required by privacy legislation, for example, where the collection, use or disclosure of personal information is solely for journalistic, artistic or literary purposes.
Limiting Use; Disclosure and Retention. Personal information shall not be used or disclosed for purposes other than those for which it was collected, except with the consent of the individual or as required by law. Personal Information shall be retained only as long as necessary for the fulfillment of the purposes for which it was collected.
Accuracy. Personal information shall be as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used.
Safeguards. Personal information shall be protected by security safeguards appropriate to the sensitivity of the information. The purposes for which information is collected, used, or disclosed by us must be those that a reasonable person would consider are appropriate in the circumstances.
Openness. We shall make readily available to our customers and employees specific information about our policies and practices relating to the management of personal information.
What & Why
We collect and use the following information to provide, improve, and protect our Services:
Account. We collect, and associate with your account, information like your name, email address, phone number, linked organizations, payment info (if applicable), and physical address. Some of our Services let you access your accounts and your information with other service providers. We may also receive personal information from our business partners and other third parties.
Services. When you use our Services, we store, process, and transmit your files (including stu like your photos, messages, comments, emails, notifications) and information related to them (for example, tags in photos). If you give us access to your contacts, we'll store those contacts on our servers for you to use. This will make it easy for you to do things like share your stu, input shipping forms, and send invitations to others to use the Services.
Usage. We collect information from and about the devices you use to access the Services. This includes things like IP addresses, the type of browser and device you use, and identifiers associated with your devices. Your devices (depending on their settings) may also transmit location information to the Services.
Cookies and other technologies. We use technologies like cookies to provide, improve, protect and promote our Services. For example, cookies help us with things like remembering your username for your next visit, understanding how you are interacting with our Services, and improving them based on that information. You can set your browser to not accept cookies, but this may limit your ability to use the Services.
We may share information as discussed below, but we won't ever sell it to advertisers or other third-parties.
Other users. Our Services display information like your name, images, and email address to other users in places like your user profile and sharing notifications. Certain features let you make additional information available to other users.
Institutional Users. If you are a Fluid Media PRO Account User, your administrator may have the ability to access and control your PRO Account. Please refer to your organization's internal policies if you have questions about this. If you are not a Fluid Media PRO Account user but interact with a Fluid Media PRO Account user (by, for example, joining a shared folder or accessing stu shared by that user), members of that organization may be able to view the name, email address, and IP address that were associated with your account at the time of that interaction.
Law & Order. We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to (a) comply with the law; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of Fluid Media or our users; or (d) protect Fluid Media’s property rights.
Retention. We'll retain information you store on our Services for as long as we need it to provide you the Services. If you delete your account, we'll also delete this information. But please note: (1) there might be some latency in deleting this information from our servers and back-up storage; and (2) we may retain this information if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.
Around the world To provide you with the Services, we may store, process and transmit information in locations around the world - including those outside your country. Information may also be stored locally on the devices you use to access the Services.
Privacy for Children
We are fully committed to children’s privacy.
Protecting the privacy of young children is especially important to Fluid Media. For that reason, we created certain features designed to help protect personal information relating to Child Users. We do not knowingly permit Child Users to register directly for our Services or use them without the direct and express permission of their parent(s) and/or guardian(s). And If we learn that personal information of a Child User has been collected on our Services without parental consent, then we will take appropriate steps to delete this information.
How children may register for and use our Properties.
Child Users cannot register for a Fluid Media account themselves or without involving a parent or legal guardian. If a Child User attempts to register for our Services, we will request the email address of that Child User’s parent or guardian in order to seek consent and authentication. No information about Child Users is retained during their registration attempt, except the parent or guardian email address for purposes of seeking consent.
If you are a parent or guardian, you may provide consent for your child’s registration by first registering yourself on our Services. Once registered, you can create a restricted account for your Child User, monitor the data on your Child User’s account, or revoke a child’s permission to use the Services by deleting the account.
Alternatively, your child can be registered to use the Services through his or her school, or through a registered organization that has taken steps to obtain parental consent. Parents always have the option to delete their Child User’s account.
Restrictions on Child User (if applicable)
We attempt to restrict a Child User’s access to certain features that could result in disclosure of Personal Information by the Child User. A restricted account may limit sharing and displaying private information about the Child User in various ways, including:
- The parent or guardian can edit personal information found in the restricted account;
- The parent or guardian can restrict Child Users from making purchases using the Services commerce capabilities;
- The profile is not shared publicly without parent or guardian consent, and only the parent or guardian and other permitted Institutional Users can see the user’s profile; and
- The Child User cannot post publically with parent or guardian consent.
Some other features of our Services may, however, permit a Child User to enter free-form text through which the Child User could enter Personal Information that would be visible to other users. If you are the parent or guardian of a Child User, please advise your Child User of the risks of posting personal information on our Services or any other online services, as information posted may be used by others without restriction.
As a parent or guardian, you have the ability to control information about your Child User. To refuse future collection or use of your child’s personal information, you can delete your Child User’s account or contact us at email@example.com.
California Children’s Privacy Rights
If you are under the age of 18, or the parent of a User under the age of 18, residing in California, you are entitled to request removal of content or information you have posted on our Services. If you would like to request removal of your or your child’s content or information, please email us at firstname.lastname@example.org assistance, or you can delete specific information (or delete your or your child’s account) directly. Please note that removal of your content or information does not ensure complete or comprehensive removal, as there may be de-identified or recoverable elements of your content or information on our servers in some form. Additionally, we will not remove content or information that we may be required to retain under applicable federal and state laws.
U.S. Children’s Online Privacy Protection Act (“COPPA”)
In the United States, if you are a Sponsor of a Child User you (or your organization) assumes the responsibility for complying with COPPA and, to the extent applicable, The Family Educational Rights and Privacy Act (“FERPA”). This means that the sponsor must notify parents/guardians of the information to be collected and obtain parental/guardian consent before collecting and sharing with Fluid Media the personal information of a Child User in order to establish an account or use Fluid Media. Organizations may under appropriate circumstances provide such consent on behalf of parents/guardians. Parents should always take care when providing any Personal Information concerning children online. We ask any parents who think a child under the age of 13 has provided us with information without the consent of the parent to contact us at email@example.com.
If you are outside of the United States, please ensure that you are complying with any laws applicable to you before submitting any child’s personal information or permitting any child to submit personal information to us.
You may specifically request to review or delete your child’s information from our database by e-mailing firstname.lastname@example.org. As an adult or parent, you should take caution in adding captions or tags to pictures which may identify the children in them.
If we are involved in a reorganization, merger, acquisition or sale of our assets, your information may be transferred as part of that deal. We will notify you (for example, via a message to the email address associated with your account) of any such deal and outline your choices in that event.
